Terms & Conditions

1 - Introduction

For the purposes of these Terms of Service (“Terms”), “Clients” are defined as any person, entity, member, or organization who obtains, purchases, downloads, accesses, or otherwise has possession or control over any Aviaris LLC product, asset, or license, regardless of acquisition method.

2 - Acceptance of Terms

By purchasing, accessing, or using any Aviaris LLC product, Clients agree to be bound by these Terms. If a Client does not agree, they must not use or retain any Aviaris LLC product.

3 - License Grant

Aviaris LLC grants Clients a non‑exclusive, non‑transferable, revocable license to use purchased products solely for their intended purpose. No ownership rights are transferred. All products remain the exclusive property of Aviaris LLC.

4 - Intellectual Property Rights

Aviaris LLC is a virtual 3D modeling asset company. All products, models, textures, configurations, and digital assets are protected under U.S. and international intellectual property laws.
 

Clients agree:

  • All products are the intellectual property of Aviaris LLC.

  • Clients may not claim any Aviaris LLC product as their own creation.

  • Clients may not remove or obscure branding, attribution, or embedded identifiers.

  • Unauthorized reproduction, redistribution, or modification for the purpose of concealment or redistribution is strictly prohibited.

5 - Prohibited Actions

5.1 Reselling Products

Clients may not resell, auction, trade, or commercially redistribute any Aviaris LLC product.

5.2 Transferring or Reselling Licenses

Clients may not transfer, resell, sublicense, share, or distribute product licenses to any third party.

5.3 Claiming Ownership

Clients may not claim Aviaris LLC products as their own work, nor imply authorship or proprietary rights.

5.4 Giving Away Products

Clients may not give away, donate, gift, or freely distribute any Aviaris LLC product, whether modified or unmodified.

6 - Commercial Use Policy

Clients may use Aviaris LLC assets in commercial projects, including video games, simulations, media productions, or other monetized works provided that:

  • The asset itself is not sold, resold, or redistributed in any form.

  • The asset is not provided to end‑users as a standalone downloadable item.

  • The asset remains embedded within the Client’s project and cannot be extracted by third parties.
     

This policy allows Clients to earn monetary gain from projects containing Aviaris LLC assets, but not from the assets themselves.

7 - Rights to Revoke

Aviaris LLC reserves the unrestricted right to revoke, suspend, or terminate any product license or usage rights at any time, for any reason, with or without notice.

Upon revocation, Clients must immediately cease use of the product and delete all copies in their possession.

8 - No refunds

All purchases made through Aviaris LLC are final and non‑refundable. By completing a purchase, Clients acknowledge that no refunds will be issued under any circumstances.

9 - Privacy & Data Handling

Aviaris LLC may collect limited information necessary for order fulfillment, account management, fraud prevention, and customer support. Aviaris LLC does not sell Client data to third parties.

Data may include:

  • Email addresses

  • Transaction records

  • Support correspondence

  • Platform usage metadata

Data is stored securely and used solely for operational purposes. Clients consent to this handling by using Aviaris LLC services.

10 - User Conduct Policy

Clients agree not to engage in any behavior that:

  • Interferes with Aviaris LLC operations

  • Attempts to bypass licensing or security systems

  • Harasses Aviaris LLC staff or other Clients

  • Damages Aviaris LLC’s reputation or intellectual property

Violation may result in license revocation, account termination, or legal action.

11 - Security & Anti‑Tampering

Clients may not:

  • Reverse engineer, decompile, or attempt to extract proprietary components

  • Modify assets for the purpose of redistribution

  • Circumvent licensing systems, DRM, or embedded protections

  • Use automated tools to scrape, clone, or duplicate Aviaris LLC products

Any attempt to tamper with product integrity or licensing mechanisms is strictly prohibited.

12 - Support & Maintenance

Aviaris LLC provides customer support via email for general inquiries, installation assistance, and troubleshooting.

However:

  • Aviaris LLC does not guarantee bug fixes, remodels, updates, or custom modifications.

  • Support availability may vary depending on workload and resource constraints.

Support is provided as a courtesy, not a contractual obligation.

13 - Digital Delivery Policy

All products are delivered digitally through online platforms, download links, or direct file transfer.

Clients are responsible for:

  • Maintaining access to the email address used during purchase

  • Downloading products promptly

  • Securing their own backups

​

Aviaris LLC is not responsible for lost downloads, corrupted files, or failure to store products safely.

14 - Account Termination

Aviaris LLC may terminate Client accounts for:

  • Violations of these Terms

  • Fraudulent activity

  • Chargebacks or payment disputes

  • Abuse of support channels

  • Attempts to redistribute or resell products

Termination may include revocation of licenses and removal of access to purchased products.

15 - Dispute Resolution

In the event of a dispute, Clients agree to attempt informal resolution by contacting Aviaris LLC first.

If unresolved, disputes shall be handled through:

  • Binding arbitration conducted in the State of Indiana

  • No class‑action claims

  • Each party bearing its own legal costs unless otherwise required by law

​

Clients waive the right to pursue litigation outside Indiana jurisdiction.

16 - Applicable Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Indiana, United States, without regard to conflict‑of‑law principles.

17 - Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force. Invalid provisions will be replaced with enforceable terms that most closely reflect the original intent.

18 - Changes to Terms

Aviaris LLC may update, modify, or amend these Terms at any time. Continued use of products after changes are posted constitutes acceptance of the revised Terms.
